The local tribunals of Clay County, Illinois that are in charge of issuing arrest warrants are legally required to exercise due diligence when releasing such orders to the sheriff’s office. To ensure that the police do not have the unrestricted authority to detain just about any community member, active warrants are based only on hard evidence.

This means that the police cannot go to court with a request for such a decree unless they have substantial proof against the person in question. When analyzing the police affidavit, the emphasis is on looking at the case from a different angle than investigating officers. A warrant is never issued just because the detectives feel that the person is guilty of the crime.

The affidavit filed has to include all evidence, circumstantial and scientific, that has been collected. Despite this, the magistrate may order the witnesses to appear in court for sworn testimony. After this process is completed, the arrest order is sent to the police; at this point, it is called an active warrant.

In contrast, such decrees are held back in the system because peace officers have been unable to spot the offenders against whom these were issued are known as outstanding warrants from Clay County.
